About Wrongful Death
Under Wisconsin statute, only certain parties can bring a wrongful death claim. Typically, it is the surviving wife or husband, or children of the deceased, unless the person had no spouse or children. The statute also determines the types of claims and damages:
- A wrongful death claim on behalf of the survivors seeks compensation for loss of consortium, companionship, support and other family contributions. There is a cap of $350,000 on these damages.
- A survival action on behalf of the deceased's estate for projected lost earnings, medical bills incurred, funeral expenses, and for the person's pain and suffering prior to death. There is no cap on these damages, which are distributed among all beneficiaries of the estate.
